Terms of Service (Beta Pilot)

1. INTRODUCTION & ACCEPTANCE

These Terms of Service ("Terms") govern your access to and use of the AI Agent and Product Intelligence Mapping Engine services ("Service") provided by Thias AI ("Provider", "we", "us"), operating from India. By accessing the Service, you ("Customer") agree to these Terms.

2. NATURE OF THE PILOT (BETA WARNING)

The Service is currently in a "Beta" / "Pilot" phase. You acknowledge that:

  • The Service utilizes experimental generative AI technologies.
  • The Service may produce erratic results, errors, or "hallucinations" (inaccurate outputs).
  • The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind.
  • Provider makes no guarantee regarding uptime, speed, or availability.

3. SCOPE OF AI AGENT AUTHORITY

  • Interaction & Navigational: The AI Agent is designed to navigate web interfaces, parse product architectures, and interact with specific UI elements (e.g., clicking buttons or filling forms) as directed by the user. While it can execute clicks and inputs within the web application, it is not authorized to execute payments, bind contracts, or modify account settings on behalf of the Customer without explicit confirmation and human oversight.
  • Human Oversight: Customer agrees to maintain human oversight of all AI outputs and actions. Provider is not liable for actions taken by the Customer or the AI Agent based on the Agent's recommendations or execution.

4. NO AI TRAINING ON CUSTOMER DATA

Provider utilizes the enterprise/API tier of third-party Large Language Model (LLM) providers (e.g., OpenAI, Anthropic, Google Gemini). Consistent with their policies, Customer Data processed during this Pilot is NOT used to train, retrain, or improve the foundational AI models of third-party vendors. Data is processed ephemerally to generate responses. Thias AI processes product graphs and page snapshots for intent parsing and executing actions, but this data remains restricted to your tenant and is not used to train our foundational models.

5. USE RESTRICTIONS

You agree not to use the Service to:

  • Access websites or data you do not have permission to view.
  • Bypass CAPTCHAs or security controls on third-party sites illegally.
  • Scrape personal data (PII) of third parties without consent.

6. INTELLECTUAL PROPERTY

  • Your Data: You retain all rights to the data you input and the specific outputs generated for you.
  • Our IP: We retain all rights to the AI Agent's underlying code, architecture, mapping engine, and methodology.

7. LIMITATION OF LIABILITY (CRITICAL)

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROVIDER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES (INCLUDING LOST PROFITS OR DATA). PROVIDER'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THIS AGREEMENT SHALL BE LIMITED TO THE AMOUNT PAID BY CUSTOMER IN THE PAST 1 MONTH OR $100 USD, WHICHEVER IS LOWER.

8. FEES & CREDITS

  • Free Pilot: During the Pilot phase, the Service is provided free of charge up to a specified limit of navigations/tokens.
  • Token Usage: Provider reserves the right to cap usage or terminate access if API costs become excessive.

9. GOVERNING LAW

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in India.
